Overview

This two day COPDOL (Court of Protection for a Deprivation of Liberty) course will focus on the legal literacy required by professionals when making applications to the Court of Protection for judicial authorisation of a deprivation of liberty. Day 1 will focus on the law to include relevant case law. Day 2 will focus on the procedure and evidence required for the application.

By the end of the course delegates will be able to:

  • Analyse the key components of legal literacy
  • Describe the relevance of public law in the Court of Protection when applied to the Care Act 2014
  • Recognise the basis concepts of capacity and best interests relevant to an application to the Court of Protection under the Mental Capacity Act 2005
  • Demonstrate an understanding of the legislation and case law which underpins an application to the Court of Protection for a deprivation of liberty order
  • Describe the role and powers of the Court of Protection
  • Demonstrate an understanding of the practice and procedure in the Court of Protection
  • Apply the knowledge and understanding to complex cases in order to successfully complete an application to the Court of Protection for a deprivation of liberty order
